Agreeing to These Terms

we also refer to as our house rules, are made up of this document and other
documents mentioned below. These terms form a binding agreement between you and
collectively referred to as Hausrupt Inc.
It’s important to note
that Section 11, which covers disputes with Botiq Bazaar, includes an
arbitration clause and class action waiver. By agreeing to the Terms, you agree
to resolve any disputes through individual arbitration and waive your right to
have such disputes Botiq Bazaar decided by a judge or jury. Additionally, you
waive your right to participate in class actions, class arbitrations, or
representative actions.
By using our Services,
including WWW.BOTIQBAZAAR.COM, Pattern by Botiq Bazaar, our mobile apps, and
any other services we provide, you agree to abide by these Terms. Please take
the time to read them carefully, as they set out your rights and
responsibilities when using our Services. If you do not agree with the Terms,
you may not use our Services. If you agree with the Terms, we welcome you to
continue using our Services.
Botiq Bazaar offers a
platform that connects people worldwide, enabling them to create, sell, and
purchase unique goods both online and offline. To ensure that you understand
the relevant rules for your use of our Services, we have provided a helpful
guide.
If you use any of our
Services, you must agree to our House Rules for Everyone, which include our
Terms, Privacy Policy, and Anti-Discrimination Policy. For Sellers, our House Rules
for Sellers apply if you list any items for sale through our Services, while
our House Rules for Buyers apply if you use our Services to browse or shop.
We also have House Rules
for Third Parties, which apply to intellectual property owners, Botiq Bazaar API
users, affiliates, and anyone requesting information from Botiq Bazaar.
Additionally, we provide a summary of how we organize search and advertising
results, which could include Your Content, in our Search and Advertising
Ranking Disclosures.
All of these policies are
part of our Terms, so please make sure to read the ones that are relevant to
you. However, it’s important to note that this document applies to everyone,
regardless of how you use our Services.
3. Privacy
At Botiq Bazaar, we
understand that your personal information is of utmost importance to you, and
that’s why it’s equally significant to us. Our Privacy Policy outlines how we
collect, use, and share your information when you use our Services. By
utilizing our Services, you agree to the processing of your information as
stated in the Privacy Policy. Therefore, we recommend that you read it
thoroughly to gain a clear understanding of our policies.
As both Botiq Bazaar and
sellers process the personal information of members, such as buyer name, email
address, and delivery address, they are deemed separate and independent data
controllers of buyers’ personal information under EU law. This implies that
each party is responsible for the personal information they process while
providing the Services. For instance, if a seller accidentally discloses a
buyer’s name and email address while fulfilling another buyer’s order, the
seller, not Botiq Bazaar, will be accountable for that unauthorized disclosure.
However, if Botiq Bazaar
and sellers are jointly recognized as data controllers of buyers’ personal
information, and if Botiq Bazaar faces legal action, penalty, or any other
expenses due to something you did as a joint data controller of buyer personal
information, you agree to indemnify Botiq Bazaar for the expenses it incurs
related to your processing of buyer personal information. Refer to Section 9.
Indemnification (or What Happens If You Get Us Sued) below for further information
regarding your indemnification responsibilities to Botiq Bazaar.
4.
Your Account
To use some of Botiq
Bazaar’s Services, you will need to create an account with them. However, there
are a few rules you need to follow regarding your account:
A. You must be at least
18 years old to use Botiq Bazaar’s Services. If you are a minor between the
ages of 13 and 17, you can only use Botiq Bazaar’s Services if you have the
permission of a parent or legal guardian and are under their direct
supervision. Children under the age of 13 are not allowed to use Botiq Bazaar
or its Services. You are responsible for any activity conducted by a minor on
your account, and Botiq Bazaar recommends considering commercial products or
services to limit a minor’s access to online content. For more information,

B. Provide truthful
information about yourself. It is forbidden to use false information or
impersonate another person or company through your account.
C. Use an appropriate
name. If you do not want to use your full name as the name associated with your
account, the language you use must not be offensive, vulgar, infringe someone’s
intellectual property rights, or violate the Terms.
D. You are responsible
for your account. You are solely responsible for any activity on your account.
If you share your account with others, the person whose financial information
is on the account will ultimately be responsible for all activity. If you
register as a business entity, you personally guarantee that you have the
authority to agree to the Terms on behalf of the business. Your accounts are
not transferable.
E. Keep your password
secure. You are solely responsible for any activity on your account, so it is
important to protect your account password. Botiq Bazaar has a Help article

F. Our relationship is
clear. The Terms do not create an agency, partnership, joint venture,
employment, or franchise relationship between you and Botiq Bazaar.

Material/content you submit
Any
content that you upload or post using our Services is considered “Your Content”
and we don’t make any claim to it. This includes any shop names, profile
pictures, listing photos, descriptions, comments, reviews, videos, usernames,
or any other content you post. You are solely responsible for Your Content and
must ensure that you have all the necessary rights to post it without
infringing on any third-party rights. By posting Your Content through our
Services, you grant Botiq Bazaar a license to use it in any way that helps Botiq
Bazaar function and grow. This includes promoting your content, your Botiq
Bazaar shop, or the Services in general. The license grants Botiq Bazaar the
right to use, display, edit, modify, reproduce, distribute, store, and prepare
derivative works of Your Content in any format and through any channels,
including across any Botiq Bazaar Services, our partners, or third-party
websites or advertising mediums. You agree not to assert any moral rights or
rights of publicity against us for using Your Content. You also recognize our
legitimate interest in using it to the extent that it contains any personal
information.
If
you notice that someone has posted Your Content on our Services without your
permission, please follow the steps listed in our Intellectual Property Policy
to have it removed. We do not want any inappropriate, false, misleading, or
offensive content posted on our Services. You agree not to post any content
that violates our Prohibited Items Policy, Community Policy, or any part of our
Terms. Furthermore, you agree not to post any content that is abusive, threatening,
defamatory, obscene, vulgar, fraudulent, or deceptive. We take intellectual
property rights seriously and will take appropriate action if we receive a
report of infringement that complies with our policies, including disabling or
removing Your Content and terminating your account if you are found to be a
repeat infringer.
6. How You Utilize Our Services
This
passage is a License to Use the Services provided by Botiq Bazaar. By using the
Services, you are granted a limited, non-exclusive, non-transferable, and
revocable license subject to the terms and certain restrictions.
Firstly,
you agree not to violate any laws when using the Services, including local,
state, federal, and international laws that apply to you. You are responsible
for obtaining any necessary permits or licenses for your shop and complying
with all legal requirements in applicable jurisdictions. This includes the sale
and delivery of your items, such as age verification upon delivery where
required by law. You must not sell anything that violates any laws or engage in
unlawful acts or crimes against Botiq Bazaar, another user, or a third party.
Secondly,
you are responsible for paying all fees owed to Botiq Bazaar and for collecting
and/or paying any applicable taxes for purchases or sales made through the
Services, except where Botiq Bazaar calculates, collects, and remits
value-added tax or VAT and sales tax.
Thirdly,
you agree not to crawl, scrape, or spider any page of the Services or to
attempt to obtain the source code of the Services without express permission.
If you want to use the API, follow the API Terms of Use.
Fourthly,
you agree not to interfere with or disrupt the Services, for example by
distributing a virus, excessive requests, or other harmful computer code.
Fifthly,
you agree to follow the Botiq Bazaar Trademark Policy when using Botiq Bazaar
trademarks, service marks, or trade dress.
Sixthly,
any ideas or materials you submit to Botiq Bazaar (excluding Your Content or
items you sell) are considered non-confidential and non-proprietary to you. You
grant Botiq Bazaar a non-exclusive, worldwide, royalty-free, irrevocable,
sub-licensable, perpetual license to use and publish those ideas and materials
for any purpose, without compensation to you.
Lastly,
you agree to the Electronic Communications Policy, which allows Botiq Bazaar to
send you legal information electronically instead of mailing paper copies. Your
electronic agreement is the same as your signature on paper.
7.
Termination
If you wish to end your
account with Botiq Bazaar, you can do so at any time through your account
settings. Keep in mind that any outstanding bills must still be paid, and
terminating your account won’t affect any content you posted through the
Services prior to termination. However, Botiq Bazaar may terminate or suspend
your account and access to the Services if they have reason to believe you
violated their Terms, and you don’t have a legal or contractual right to
continue using the Services. They will generally notify you of termination,
unless you’ve repeatedly violated their Terms or there are legal or regulatory
reasons preventing them from doing so. If your account is terminated, you may
lose any associated information, including your content. Additionally, Botiq
Bazaar reserves the right to change, suspend, or discontinue any Services at
any time, for any reason, and the Terms will remain in effect even after
termination or use of the Service ends.

Warranties and Limitation of Liability
When you purchase items
through Botiq Bazaar’s services, you acknowledge that the items are produced,
listed, and sold directly by independent sellers, and not by Botiq Bazaar.
Therefore, Botiq Bazaar cannot make any warranties regarding the quality,
safety, authenticity, or legality of the items. Any legal claims related to an
item you purchase must be directed towards the seller of the item. You also
release Botiq Bazaar from any claims related to items sold through their
services, including claims related to defective items, misrepresentations by
sellers, or items that caused physical injury, such as product liability
claims.
While using Botiq Bazaar’s
services, you may come across content that you find inappropriate or offensive.
Botiq Bazaar does not guarantee the accuracy, copyright compliance, legality,
or decency of content posted by users through their services, and is not
responsible for such content. Therefore, you release Botiq Bazaar from all
liability relating to any content that you access through their services.
When interacting with
other individuals through Botiq Bazaar’s services, either online or in person,
you understand that Botiq Bazaar does not screen users, except for certain
compliance and legal obligations. Therefore, you release Botiq Bazaar from all
liability relating to your interactions with other users, and should exercise
caution and good judgment in all interactions with others.
Botiq Bazaar’s services
may contain links to third-party websites or services that Botiq Bazaar does
not own or control. When accessing these third-party services, you do so at
your own risk and are subject to their own terms of use. Therefore, any
agreements or disputes are solely between you and the third party, and Botiq
Bazaar is not a party to such agreements.
Botiq Bazaar does not make
any warranties regarding gift cards and is not responsible for any unauthorized
access, alteration, theft, or destruction of gift cards or gift card codes
resulting from actions by you or a third party. If your gift card code stops
working, your only remedy is for Botiq Bazaar to issue you a replacement gift
card code. By participating in special offers or promotions, you agree that you
may not later claim that the rules of the offer were ambiguous.
Botiq Bazaar’s services
are provided “as is” and without any warranty, whether express or
implied. Botiq Bazaar expressly disclaims any warranties regarding title,
non-infringement, merchantability, fitness for a particular purpose, course of
performance, course of dealing, or usage of trade. Botiq Bazaar does not
guarantee that the services will be secure or available at any particular time
or location, free of viruses or other harmful materials, or that the results of
using the services will meet your expectations. You use the services solely at
your own risk.
To the fullest extent
permitted by law, neither Botiq Bazaar nor its employees or directors shall be
liable for any lost profits or revenues, or for any consequential, incidental,
indirect, special, or punitive damages arising out of or in connection with the
services or these terms. In no event shall Botiq Bazaar’s aggregate liability
for any damages exceed the greater of one hundred US dollars or the amount you
paid Botiq Bazaar in the past twelve months. Some jurisdictions do not allow
limitations on incidental or consequential damages, so the above limitations
may not apply to you.
9. Indemnification
In the unfortunate event
that Botiq Bazaar faces legal action as a result of your actions, you agree to
indemnify and defend us. This means that you will protect Botiq Bazaar,
including our employees, and hold us harmless against any legal claims or
demands, including reasonable legal fees, arising from your use or misuse of
our Services, your actions, your violation of the Terms, or any infringement by
you or your account of another’s rights.
We retain the right to
manage our legal defense as we see fit, even if you are indemnifying us. In
such cases, you agree to cooperate with us to enable us to implement our legal
strategy.
10.
Disputes with Other Users
In case you encounter a
disagreement with another user of Botiq Bazaar’s Services or a third party, we
suggest that you make an effort to reach a peaceful resolution by contacting
the other party directly. For transactions on our websites or mobile apps,
buyers and sellers who are unable to settle a dispute can participate in our
case system, which is explained in detail in this Help article. It’s important
to note that Botiq Bazaar will attempt to assist you in resolving disputes in
good faith and according to our policies, but we will not render judgments on legal
matters. Additionally, Botiq Bazaar has no obligation to settle any disputes.
By agreeing to these terms, you release Botiq Bazaar from any and all claims,
demands, or damages that may result from disputes with other users or parties.
11.
Disputes Resolution
In case you have any
grievances with our services, we urge you to let us know so we can try to
resolve the issue. However, if we are unable to do so, the following rules will
govern any legal disputes related to our services:
A. The Terms will be governed
by the laws of the State of Texas and the United States of America. These laws
apply to all users worldwide, but if you live outside the US, your local
consumer protection law may offer additional protections.
B. Any disputes or claims
related to the Terms will be resolved through final and binding arbitration
administered by the American Arbitration Association (AAA), using its Consumer
Arbitration Rules. The arbitration will be conducted in English and handled by
a sole arbitrator. The award can be entered as a judgement in any court with
jurisdiction. If you are an EU seller, the parties can attempt to resolve the
dispute through the complaints procedure published on our website or through
mediation by the Centre for Effective Dispute Resolution (CEDR) before
resorting to arbitration.
C. The cost of
arbitration and mediation will be in accordance with the AAA and CEDR rules. Botiq
Bazaar will not pay any filing, administrative, and arbitrator fees, unless the
arbitrator finds the claim to be frivolous or brought for an improper purpose.
In mediation through CEDR, the parties will pay their share of mediation costs,
which may be refundable under certain conditions.
D. Legal actions against Botiq
Bazaar must be filed in Texas, where we are based. In-person hearings will be
conducted at a mutually convenient location. Any actions not subject to
arbitration or mediation will be heard in a state or federal court located in Texas,
if your contract is with Botiq Bazaar.
E. Any changes to the
“Disputes with Botiq Bazaar” section will not apply to claims filed
before the effective date of the changes. We will notify you of any substantive
changes at least 30 days before they take effect. If you do not agree to the
modified terms, you may send us a written notification or close your account
within those 30 days. Rejecting the modified terms or permanently closing your
account means you agree to arbitrate any disputes based on the previous version
of the Terms. Reopening your closed account or creating a new one means you
agree to the current version of the Terms.
12.
Modifications to the Terms
Occasionally, we might
make revisions to these Terms. In the event that we consider these changes to
be significant, we will make sure to inform you by publishing them via the
Services and/or by sending you an email or message regarding the changes. This
will give you the opportunity to decide whether you wish to continue using the
Services or not. The changes will become effective as soon as they are
published, unless stated otherwise. You have the responsibility of reviewing
and familiarizing yourself with any modifications. If you continue to use the
Services following the changes, it implies that you have accepted the updated
Terms.

Additional legal considerations
The Terms, comprising all
policies that are part of it, take precedence over any other agreement between
you and Botiq Bazaar related to the Services. If any part of the Terms is
deemed unenforceable, it will only be restricted to the minimum extent
necessary to maintain the full force and effect of the Terms. The fact that we
do not enforce any part of the Terms does not mean that we waive our right to
enforce that or any other part of the Terms at a later time. We reserve the
right to assign any of our rights and obligations under the Terms.

ensure that all items listed for sale on Botiq Bazaar meet a certain standard,
they must be in a new condition and are never used before located within the
seller’s country, and ready for shipping by the seller. Pictures should be
uploaded with high resolution with a clutter-free background and meet high
standards of the platform put in place to maintain the brand standards and in
turn help the vendors with driving more traffic to sell their products. Drop
shipping is not allowed. To register, you need to be based in the USA and have
the products stocked within the USA.
Handmade
items are those that are created and designed by the seller themselves, and the
seller must adhere to certain policies outlined in the Handmade Policy section.
Specifically, sellers who create handmade items must ensure that they
accurately disclose any production partners, describe all individuals involved
in making an item, and use only their own photographs or video content. This
helps ensure transparency and honesty in the marketplace, which ultimately
benefits both buyers and sellers.
If you sell personalized
or made-to-order items in the Handmade category on Botiq Bazaar, there are
certain requirements you must follow. Firstly, all listings for such items must
be available for purchase at a fixed price. Additionally, if you choose to use
photographs of previous work that have customization options, such as different
color choices, included in the listing, you must be transparent about this in
your item description. This means you must make it clear that the photos
provided are simply examples of what the finished product might look like, and
that the final product may differ slightly based on the customer’s specific

What can’t be Sold on Botiq Bazaar
Items, services, or any
other listings that violate Botiq Bazaar’s intellectual property policies or
fall under the category of prohibited items are strictly not allowed to be sold
on the marketplace, even if they meet other criteria. All listings must have a
physical or digital item available for sale, including reserved listings and
digitally delivered items. It is not permissible to create listings solely for
the purpose of sharing referral codes, posting want ads, or any similar
activities that do not involve the sale of a product. In the handmade category
on Botiq Bazaar, reselling is prohibited. This means that you cannot list an
item as handmade if you were not involved in its design or creation. Please
note that if any listings appear to violate Botiq Bazaar’s policies, members or
third parties may flag them for Botiq Bazaar’s review, and Botiq Bazaar has the
authority to remove any such listings. The fees charged for listing items on Botiq
Bazaar are non-refundable, and any outstanding fees must still be paid even if
your account is suspended or terminated for policy violations. If you are
raising funds for a charity, you must obtain the charity’s consent first.

Managing your Botiq Bazaar Shop
When you sell on Botiq
Bazaar, your shop represents you and your business to the Botiq Bazaar
community. As such, it is important that you, your items, and your shop are
accurately and honestly represented. By selling on Botiq Bazaar, you agree to
provide honest and accurate information to Botiq Bazaar and in your About
section, honour your Shop Policies, and ensure that any text, photos, or videos
used to represent yourself, your shop, or your listings comply with Botiq
Bazaar’s policies, including its Anti-Discrimination Policy.
You also agree to
accurately represent your items in your listings and listing photos, respect
the intellectual property of others, and report any violations of your own
intellectual property rights to Botiq Bazaar. Additionally, you agree not to
engage in fee avoidance, create duplicate shops, or take any other actions (such
as manipulating clicks, baskets, or sales) for the purpose of shilling,
manipulating search, or circumventing Botiq Bazaar’s policies.
Finally, you agree not to
coordinate pricing with other sellers on the platform. By adhering to these
guidelines, you help ensure that you and your shop have a positive reputation
within the Botiq Bazaar community.
d.
Seller Standards
To list a product for
sale on Botiq Bazaar, you agree to comply with all applicable laws and
regulations related to the product you list, including the provision of any
required labels and warnings. It is your responsibility to ensure accuracy,
labelling, and content of your listings. Botiq Bazaar assumes no responsibility
in this regard. As a seller, you must provide excellent customer service and
maintain trust with your buyers. This is known as the Seller Service Level
Standards, and if your shop fails to meet these standards, Botiq Bazaar may
contact you. By selling on Botiq Bazaar, you agree to fulfill the dispatch and
processing times promptly, respond to messages in a timely manner, honor the
commitments made in your shop policies, and resolve disagreements or order
issues directly with the buyer. If you are unable to complete an order, you
must inform the buyer and cancel the order. Legal requirements for dispatch
times vary by country, and you can read more about this in Botiq Bazaar’s

you cannot reach a resolution with the buyer.

Selling Fees
Using certain services on
Botiq Bazaar may result in charges for sellers. This includes fees associated
with listing, selling, advertising, and some other features and products

Being a Member of the Botiq Bazaar Community
The Botiq Bazaar
community upholds the value of respect towards all its members. Sellers, in
particular, have an added obligation to protect the privacy of personal information
and maintain prompt communication with buyers to ensure a positive customer
experience.

Creating and Uploading Content
In Botiq Bazaar, you have
the ability to create and share various types of content such as listings,
messages, photos, videos, and text. However, it is important that you adhere to
certain guidelines to maintain a safe and respectful community. By agreeing to
these guidelines, you understand that you cannot upload any content that is
considered hateful, derogatory, or discriminatory in accordance with Botiq
Bazaar’s Anti-Discrimination and Hate Speech Policy. Additionally, you cannot
upload content that contains threats, harassment, or violates Botiq Bazaar’s
rules regarding interference. You must also respect the intellectual property
rights of others and ensure that your content is not false, deceptive,
misleading, or contains spam or unsolicited advertising. Furthermore, you must
not share private information, encourage transactions outside of Botiq Bazaar’s
checkout process, make prohibited medical drug claims, or violate any of the
rules described in the Prohibited Items Policy. It is important to note that

As a seller on Botiq
Bazaar, you must protect the personal information of the members you interact
with and comply with all applicable legal requirements. This includes data
protection and privacy laws that dictate how you can use user information on Botiq
Bazaar. You may need to post and comply with your own privacy policy, which
must be accessible to users on Botiq Bazaar. Your policy should be consistent
with Botiq Bazaar’s Terms of Use and Privacy Policy.
When you use Botiq Bazaar’s
services to sell products or utilize Botiq Bazaar’s API, you may receive
personal information from users, such as their name, email address, and
delivery address. As a result, under EU law, you become an independent
controller of the data related to other users that you obtain through the
services. You are responsible for processing this personal information and
complying with any applicable data protection and privacy laws.
If you disclose personal
information without the buyer’s consent, you are liable for that unauthorized
disclosure, including unintentional data breaches. You may use this information
only for Botiq Bazaar-related communications or transactions. You may not use
this information for unsolicited commercial messages or unauthorized
transactions. You may not add any Botiq Bazaar member to your email or physical
mailing list, use the buyer’s identity for marketing, or obtain or retain any
payment information without their consent.
You must understand the
required standard of consent in each instance. If Botiq Bazaar and you are
found to be joint data controllers of personal information, and if Botiq Bazaar
is sued, fined, or otherwise incurs expenses due to something you did as a
joint data controller of buyer personal information, you must indemnify,
defend, and hold Botiq Bazaar harmless against any claims, costs, losses,
damages, liabilities, judgments, and expenses (including reasonable lawyer
fees) related to your processing of buyer personal information.

Communication Standards
i. Messages
The statement explains
that as a member of the Botiq Bazaar community, you are expected to abide by
certain rules when communicating with others through Botiq Bazaar’s
“Messages” feature. While Messages are a great way for buyers to ask
sellers questions about items or orders, they should not be used for activities
such as sending unsolicited advertising or promotions, requesting donations or
spam, harassing or abusing another member, interfering with a transaction or
the business of another member, or exchanging personal contact, financial, or
other information to evade the checkout process on Botiq Bazaar. Additionally,
it is important to respect other members’ explicit requests not to be

Interference
Interference on Botiq
Bazaar refers to the intentional actions of one member to harm another member’s
business. Any form of interference is strictly prohibited on the platform.
Examples of interference include sending messages to other members to warn them
against a particular shop or item, publicly posting to demonstrate or discuss a
dispute with another member, purchasing from a seller solely to leave a
negative review, maliciously clicking on a competitor’s ads to deplete their
advertising budget (known as “click fraud”), and using an independent
buyer account to upvote negative reviews of a shop in order to increase their
visibility.
i.
Harassment and Discrimination
Using Botiq Bazaar’s
Messages to harass other members or promote hate is not allowed and is a
violation of the platform’s Anti-Discrimination Policy. If you receive a
message that goes against this policy, it is important to report it to Botiq
Bazaar immediately.
ii.
Forums and Teams
A possible rephrased
version: Botiq Bazaar offers public spaces called Forums and Teams to allow
sellers to connect with each other. However, it is important to follow certain
communication standards while using these spaces. For more information on these
standards, please refer to the Botiq Bazaar Community Policy.
iii.
Communicating Cancellations
As a seller on Botiq
Bazaar, if you are unable to complete a transaction, you are required to notify
the buyer through Messages and cancel the transaction. If the buyer has already
made a payment, you must issue a full refund. It is recommended that you keep
proof of refunds in case of disputes. All cancellations must adhere to the
Cancellation Policy.
Buyers in the European
Union (EU) and the UK have a 14-day “right of withdrawal” after receiving an
item, during which they may return an item for any reason. However, this right
may not apply to certain items, such as custom items or perishable goods. The
specifics of this right vary by EU member state or in the UK, and the rights
with respect to digital items also differ by country. For more information,
refer to the Help article on the EU and UK Right of Withdrawal.
It’s important to note
that in addition to Botiq Bazaar’s policy, each country has its own laws
regarding delivery, cancellations, returns, and exchanges. So, make sure you
are familiar with the laws of your own country as well as the buyers’
countries.
Sellers still have the
option to cancel an order and work towards a resolution with the buyer in
accordance with the policies applied to their shops, such as the digital items
policy.
3.
Feedback, Cases and Your Success
a.
Reviews
Reviews are an excellent
way to establish a reputation on Botiq Bazaar. Within 100 days of the item’s
estimated delivery date, buyers can leave a review, including a rating of one
to five stars and a photo or video of their purchase. If there is no estimated
delivery date, the review window opens after the order’s processing and
delivery times have passed. Buyers can modify their review, including the photo
or video, as many times as they like during that 100-day period.
If you receive an
unfavorable review, you can contact the buyer or leave a response. However,
reviews and your response to them must adhere to the rules for creating and
uploading content in Section 2a. They may not contain graphic, mature, or
obscene language or imagery, or any content that is subject to the mature
content policy. Reviews should not be about things outside the seller’s
control, such as a delivery company, Botiq Bazaar, or a third party. Shilling
or falsely inflating a shop’s review score is not allowed, and the integrity of
the Reviews system must not be compromised.
b.
Botiq Bazaar’s Case System
The Case system is the
way a buyer informs Botiq Bazaar of any issues or disputes with an order that
they cannot resolve with a seller, to seek assistance from Botiq Bazaar in
reaching a resolution. Before opening a case, buyers must try to settle any
problems directly with sellers by using the Help with Order link. Therefore, it
is crucial for sellers to have their shop policies updated and respond to
messages from buyers regularly. Once a buyer contacts you with an issue, you
have 48 hours to resolve it. If the issue remains unresolved, the buyer may
open a case, and Botiq Bazaar will step in to assist in the resolution. This
may involve closing the case and issuing a refund or reviewing the case further
to find a solution as quickly as possible. However, Botiq Bazaar has the right
to intervene and resolve an order issue before the 48-hour window in certain
circumstances, including seller inactivity, harassment, refusal of service,
manipulation, and compromise to the integrity of the case system. As part of Botiq
Bazaar’s Purchase Protection Programme, buyers may open cases for items that
never arrived, arrived damaged, or do not match the listing description. In
certain cases, Botiq Bazaar may ask for the seller’s assistance in resolving
the case. When you use Botiq Bazaar’s case system, you acknowledge that your
personal information may be used to settle disputes with other members. For
more information on Botiq Bazaar’s privacy policy, click here. If the case is
not covered under Botiq Bazaar’s Purchase Protection Programme for Sellers, and
unless required by law, the seller is obliged to refund the order, including
original and return postage. Botiq Bazaar has the right to issue a refund to
the buyer and collect funds from your account, including payment account
reserve, if the payment was made through Botiq Bazaar Payments.
c.
Your Seller Account and Botiq Bazaar’s Terms
To maintain the safety
and quality of our Services, Botiq Bazaar may take various actions that affect
your shop, listings, or payment account. If your shop exhibits unusual order
activity or any other actions that could result in buyer disputes, chargebacks,
fraud, counterfeiting, or similar claims, Botiq Bazaar may limit the visibility
of your shop, listings, or ads, or place restrictions or reserves on your
payments account in accordance with our Terms of Use, including this Policy and
our Botiq Bazaar Payments Policy. If possible, Botiq Bazaar will communicate
relevant information to you regarding these actions.
If a shop experiences a
sudden spike in orders, it may result in an increase or decrease in search
ranking. Positive reviews and high fulfillment rates often lead to higher
visibility and search rank, while a rapid increase in orders may decrease
visibility. Additional information on how Botiq Bazaar search works, what
factors impact search ranking, and tips for optimizing listings can be found in
our guide on Botiq Bazaar search.
To ensure the safety and
quality of our Services, Botiq Bazaar may also limit the visibility of listings
or ads that include prohibited terms or violate third-party policies. These
listings or ads may have restricted visibility, but they can still be found
through search. Botiq Bazaar may also make changes to onboarding or
authentication processes for sellers as needed for account activation or
continued usage.
If Botiq Bazaar suspects
that you or your content violates our Terms or this Seller Policy, we may
deactivate your content or suspend or terminate your account and access to our
Services. In most cases, Botiq Bazaar will notify you of these actions, unless
we have legal or regulatory reasons preventing us from doing so.
Fees
and Payments Policy
Botiq Bazaar’s services
may attract charges for sellers, as outlined in the Fees & Payments Policy,
which elaborates on the applicable fees and taxes, as well as the appropriate
payment procedures.
1.
Types of Fees
The following fees may be
mandatory for sellers, and it is worth noting that they are all stated without
factoring in any applicable value-added tax (VAT) or comparable levies. Further
particulars on taxes can be found in the Taxes section below. It is significant
to acknowledge that all service fees, comprising prepaid fees, are
non-reimbursable.
Listing Fees
Unless agreed with the
store manager there is a fee of 0.90 USD will be charged for every item that
you list for sale on WWW.BOTIQBAZAAR.COM or Botiq Bazaar’s mobile apps. Only
creating or renewing a listing on Botiq Bazaar incurs a listing fee; modifying
a listing does not. The listing fee applies regardless of whether or not the
item sells, except for private listings, which only incur a fee when sold.
Listings on WWW.BOTIQBAZAAR.COM expire
after four months. If you list multiple quantities of the same item, the
initial listing fee will be 0.90 USD, and the listing will be renewed
automatically at 0.90 USD after each sale. Listing fees are debited from your
payment account upon publishing or renewing the listing or deducted from the
sale proceedings.
Botiq Bazaar’s automatic
renewals feature, unless deactivated, will renew your listings automatically at
the end of the four-month listing period, with a charge of 0.90 USD for each
listing until you cancel the automatic renewal option. You may view the status
of automatic listings in your Listings Manager, and terminate automatic
renewals at any time by choosing “Manual” instead of “Automatic” in the
“Renewal Options” in the Listings Manager. Once you cancel, you will only be
charged for the current listing period.
Transaction Fees
Upon selling an item
through WWW.BOTIQBAZAAR.COM, a transaction fee of 10% of the price displayed
for each listing, as well as the amount charged for any delivery and gift
wrapping, will be charged. If you are an Botiq Bazaar Payments user and you
list your items in a currency different from your payment account currency,
please refer to the Currency Conversion section below for more information on
the transaction fee. If you sell from the US, the transaction fee will not be
applicable to sales tax. However, if you sell from any location other than the
US, the transaction fee will be applicable to the listing price (which should
include any relevant taxes that you, as a seller, are accountable for), postage
price, and gift wrapping fee. If you offer personalization for an additional
fee, the extra personalization fee is included in the price displayed for the
listing, and the entire displayed price is subject to the same transaction fees
as stated in this section. Please refer to the Taxes section below for more
information on whether you are required to incorporate relevant taxes in your
listing prices. Transaction fees are subtracted from your current balance at
the time of each sale and are reflected in your payment account.
Advertising and
Promotional Fees
Botiq Bazaar provides
various services to assist you in promoting your shop and advertising your
listings, such as Botiq Bazaar Ads and Offsite Ads. If you choose to use Botiq
Bazaar Ads, you can determine your maximum daily budget, which is explained in
greater detail below. On the other hand, fees for Offsite Ads are solely charged
if Botiq Bazaar successfully advertises your listing, leading to a sale.

Botiq
Bazaar Ads Fees
By utilizing the
Advertising Dashboard in Shop Manager, you can purchase paid advertising on Botiq
Bazaar and establish a budget to regulate the amount you wish to spend on Botiq
Bazaar Ads to advertise your listings or shop. Your daily maximum budget can be
established at or above a pre-established minimum designated by Botiq Bazaar,
and you will not be billed more than your maximum budget on a daily basis. Bids
are made in United States dollars (USD) for all advertisements. Botiq Bazaar
Ads costs might be billed on a regular basis, and they will be deducted from
your current balance and displayed in your payment account. More information
can be found in the Advertising and Marketing Policy.
Offsite
Ads Fees
Botiq Bazaar offers
offsite advertising to promote listings and shops on partner sites such as
social networks and search engines. If a buyer clicks on an ad and places an
order from your shop within 30 days, you will be charged an advertising fee for
that order, called an “Attributed Order.”
The fee charged for
Attributed Orders depends on your shop’s sales over the previous 365 days. If
your shop has made less than $10,000 USD in sales over the past year, you will
be charged a standard fee of 15% on Attributed Orders. However, you can choose
to opt-out of participation in offsite ads if your shop remains under the
$10,000 USD threshold.
Once your shop reaches
$10,000 USD or more in sales over the previous 365 days, you will be charged a
reduced fee of 12% on Attributed Orders. If you previously opted out of
participation, you will be required to participate and will be charged the 12%
fee upon reaching the threshold.
Botiq Bazaar calculates
your shop’s sales on the first day of each month and notifies you if you have crossed
the $10,000 USD threshold. To calculate sales, Botiq Bazaar multiplies item
price by quantity, excluding discounts, cancelled orders, Botiq Bazaar fees,
postage, taxes, and gift wrap. The $10,000 USD threshold is calculated using Botiq
Bazaar’s currency exchange rates at the time of the relevant sales.
How Offsite Ads fees are
calculated:
The fee for Offsite Ads
is based on a percentage of the total amount of an Attributed Order, which
includes the price of each listing, the cost of shipping, and in some cases,
taxes. The applicable percentage charge is determined based on the criteria
discussed earlier. If you use Botiq Bazaar Payments and list items in a
different currency than your payment account currency, the Currency Conversion
section provides more information on how Offsite Ads fees apply. For sales tax
in the US, Offsite Ads fees will not be charged, but for other locations,
applicable taxes included in listing prices will be subject to Offsite Ads
fees. If you charge extra for personalization, the added fee will be included
in the total display price, which is subject to the same Offsite Ads fees.
There is no limit to the number of Offsite Ads fees you may be charged on
Attributed Orders, but the total fee charged for a single order cannot exceed
100 USD. The fees are deducted from your current balance and reflected in your
payment account.
Payment Processing Fees
For eligible Botiq Bazaar
shops, you can use Botiq Bazaar Payments to accept payments for online sales.
Every transaction made through Botiq Bazaar Payments incurs a payment
processing fee, which varies based on the location of your bank account. These
fees are charged by the payment processing providers and are not related to
Botiq Bazaar’s listing fees or Transaction fees. In some markets, a fixed
deposit fee may also be charged for disbursements of seller funds that are
below certain designated thresholds. You can refer to the Botiq Bazaar Payments
Policy to learn more about the payment processing fees and deposit fees for
your country. The payment processing fee is calculated based on the total sale
amount, including tax and postage, and is deducted from the sale amount in your
payment account. Meanwhile, deposit fees are deducted from your Available Funds
and reflected in your payment account at the time of your scheduled deposit.
Current Payment platform fees that Stripe company
charges are 2.9% + 30¢ (per successful card charge)
Delivery Fees
Botiq Bazaar allows
eligible sellers in certain locations to buy postage labels to fulfill their
orders. The cost of the label depends on factors such as the delivery company
used, the package’s origin, destination, weight, and dimensions. If you choose
to add signature confirmation or insurance, their fees will be included in the
total cost of the label at the time of purchase. Additionally, sellers can
purchase parcel insurance through licensed insurance carriers. For US sellers
who purchase USPS postage return labels, charges are applied after the package
is delivered back. To purchase postage labels through Botiq Bazaar, you must
accept Botiq Bazaar Payments or PayPal as payment methods. Any postage fees or
adjustments will be shown in your payment account and deducted from your
current balance.
Regulatory Operating Fees
Sellers located in
certain countries will incur a Regulatory Operating fee for each transaction.
This fee is a fixed percentage of the listing price and any applicable postage
charges (including gift wrapping and personalization fees, if any). It is
charged in addition to other fees mentioned in this policy and is intended to
cover the extra costs associated with operating in that country, such as the
costs of complying with relevant regulations. The percentage of the fee may
differ depending on the country.
Currency Conversion
Except for the
transaction fee, Offsite Ads fees, Payment Processing fee, Regulatory Operating
fees, and deposit fees, Botiq Bazaar converts fees from USD to your payment
account currency at the market rate when the fee is reflected in your payment
account. All fees appear in your payment account in your domestic currency.
However, if you’re an Botiq Bazaar Payments user based in Bulgaria, Croatia,
Czech Republic, Hungary, Poland, or Romania, all fees will be deducted from
your payment account in Euro.
Transaction fees, Offsite
Ads fees, and Regulatory Operating fees: If you list your items in a currency
different from that of your payment account, the transaction fee, Offsite Ads
fee, and Regulatory Operating fee (where applicable) will be converted to your
payment account currency at the market rate and reflected in your payment
account.
To avoid foreign exchange
charges on your sales, Botiq Bazaar suggests that you list your items in the
same currency as your payment account currency. Buyers will see the items in
the currency of their choice. If you decide to list your items in a currency
other than your payment account currency as an Botiq Bazaar Payments user,
you’ll be charged a 2.5% currency conversion fee on the sale amount to send
funds to your payment account. The payment processing service automatically
handles currency conversion, as explained in Botiq Bazaar’s Payments Policy.
Any attempt by a seller
to avoid paying a fee is considered fee avoidance and is prohibited by Botiq
Bazaar. This includes, for instance, encouraging buyers to buy an item from
your Botiq Bazaar shop through another venue. Transactions initiated on Botiq
Bazaar may not be completed outside of Botiq Bazaar. The price stated in each
listing description must accurately represent the sale. Sellers must not change
the item’s price after a sale to avoid Botiq Bazaar transaction fees,
misrepresent the item’s location, or use another user’s account without
permission.
Botiq Bazaar will
automatically deduct all fees owed from your payment account. As long as there
are enough funds in your payment account, no further payment action is
required. If your payment account doesn’t have enough funds, you’re responsible
for paying all fees due in full within 15 days of your monthly statement.
Otherwise, your account will be past due, and Botiq Bazaar may charge your card
on file or take other steps to recover the funds, as stated in the Recoupment
section of Botiq Bazaar’s Payments Policy. If you make a sale while you have an
outstanding balance, the net sale amount will be applied to your outstanding
balance. You can pay your outstanding balance manually using a credit card,
debit card, or PayPal. US sellers may also sign up for AutoBilling, Botiq
Bazaar’s automatic payment of outstanding fees.
Your statement, which
includes all sales and fees activity from the previous month, is available at
the beginning of each month in your payment account. Learn more about paying
your outstanding balance in this Help article. Botiq Bazaar may suspend your
selling privileges at any time if you have an outstanding balance.
AutoBilling (US Sellers
Only)
If you choose to enroll
in Botiq Bazaar’s AutoBilling program, any outstanding fees that are not
covered by the funds in your payment account will be automatically charged to
the credit card on file on the first day of each month or when your balance
reaches the designated fee threshold. By enrolling in the program, you agree to
the following terms:
A. You authorize Botiq
Bazaar to keep your payment card information on file and to charge the card on
file on the first day of each month for the previous month’s outstanding
charges and when the balance of fees reaches the designated fee threshold. Upon
enrollment, Botiq Bazaar will charge your current balance to the card on file.
B. When your card is charged, Botiq Bazaar will send you an email with the
amount charged, and you can also review this information by accessing your
account on Botiq Bazaar. C. If your card on file is closed, the account number
changes, or a charge is rejected by your card issuer, you must update your card
information or add a new card number in your Botiq Bazaar account. If the
charge is refused for any reason, your Botiq Bazaar account may be suspended or
terminated, and you are still required to pay your outstanding balance by some
other means. Your authorization applies to any successor or replacement card
you or your card issuer provides. D. You can cancel AutoBilling and change to manual
payment by updating your payment settings in your Botiq Bazaar account. Botiq
Bazaar requires a reasonable period of time to act after receiving your notice,
meaning that an additional automatic payment may be made to your card account
while processing your request. E. Members whose accounts are suspended or
terminated are still obligated to pay Botiq Bazaar for all unpaid fees.

to accept various forms of payment in their local currencies, including major
credit or debit cards, Botiq Bazaar Gift Cards, Botiq Bazaar Credits, Botiq
Bazaar Coupons (subject to applicable limitations), certain bank transfer
services, PayPal (where available), Apple Pay, Google Pay, and Klarna (where
available).
5. Taxes
Except for the exceptions
specified below, it is your responsibility to collect and pay any taxes related
to using and selling through Botiq Bazaar’s services. Please note that for the
purposes of these Terms, although some countries may use other terms like
“GST” or “HST” to refer to VAT, we will use the term
“VAT” to refer to VAT, GST, HST, and any local sales taxes unless the
context demands otherwise.
A. Listing your items on Botiq
Bazaar
To ensure compliance with
relevant US tax laws, Botiq Bazaar will compute, gather, and pay sales tax on
your behalf for orders shipped to customers residing in US locations. The sales
tax settings in Shop Manager are applicable for states/regions where Botiq
Bazaar does not automatically collect sales tax on your behalf.
If you are selling on Botiq
Bazaar and residing in Canada, you must incorporate relevant taxes in your
listing prices, except in cases where local tax regulations mandate that Botiq
Bazaar collects taxes on your behalf. Since various jurisdictions in Canada
have different collection requirements for online marketplaces, including
GST/HST and provincial sales taxes, Botiq Bazaar may apply taxes to sales on a
tax-excluded basis using the appropriate factors to avoid double taxation of
your prices.
If you are selling on Botiq
Bazaar and living outside the US or Canada, you may need to include relevant
taxes in your listing prices.
In instances where Botiq
Bazaar is required to collect sales tax/VAT on your behalf, the category
assigned to each listing by you will be used by Botiq Bazaar to compute,
collect and pay the relevant taxes. You are solely responsible for ensuring
that all your listings are correctly categorized, and you consent to indemnify Botiq
Bazaar for any losses it incurs as a result of any incorrect categorization of
your listings by you.
Please note that Botiq
Bazaar’s fees do not cover any withholding taxes that may apply in your home
country. You must pay Botiq Bazaar the full amount of its fees, and you may not
subtract any applicable withholding taxes from that amount. In specific
jurisdictions, Botiq Bazaar may withhold taxes from payments made to you or on
your sales made through Botiq Bazaar.com if required to comply with relevant
laws.
B. Taxes on Seller
Services
VAT on Seller Fees
Botiq Bazaar may need to
add Value Added Tax (VAT) to the seller fees charged each month and pay it to
the relevant tax authority depending on your business status and location. All Botiq
Bazaar fees for sellers in countries where VAT is applicable are subject to
VAT. Please note that the fees mentioned in this policy do not include VAT.
C. Taxes We Collect and
Remit from Buyers
United States Sales Tax
Botiq Bazaar will collect
the sales tax amount from the buyer and pay it to the relevant tax authority in
most US states. This applies as appropriate. If the sale was made through Botiq
Bazaar Payments, the sales tax amount will appear in your payment account and
will be deducted from your current balance. For items delivered to certain
states, including but not limited to Washington state, and for digital items
purchased with a billing address in Washington state, Botiq Bazaar will use the
category assigned to each listing to calculate, collect, and remit the
applicable sales tax based on the buyer’s location in the US.
Digital VAT Fees
In certain countries,
local laws require Botiq Bazaar to collect and remit VAT to the relevant tax
authorities for digital items that are delivered via automatic download to the
buyer. To ensure the correct amount of VAT is collected from the buyer, Botiq
Bazaar will display an increased amount charged to the buyer automatically and
remit it to the tax authorities. If the sales were made through Botiq Bazaar
Payments, Botiq Bazaar will collect the VAT amount from the buyer and pay it to
the relevant tax authority, and you don’t need to take any further action.
However, if the sale was not made through Botiq Bazaar Payments, you’ll receive
the additional amount paid by the buyer for the VAT, and you’ll need to pay
this amount to Botiq Bazaar. The VAT amount paid by the buyer will be shown in
your payment account and will be deducted from your current balance. For more
details, you can refer to this Help article.
6.
Other Governmental Fees, Charges and Levies
In some cases, Botiq
Bazaar may be obliged by law to collect additional fees, charges, or levies
(such as environmental fees) from buyers and remit those amounts to the
appropriate government authorities. These charges will be presented to buyers
at checkout when Botiq Bazaar is obligated to collect them.
7.
Marketplace Reporting of Seller Information
Botiq Bazaar will
disclose your personal information and transaction details to governmental
authorities if required by law.
Botiq Bazaar will only
share personal information with third parties if it is legally obligated to do
so, and otherwise, it will maintain the confidentiality of such information.
8.
Botiq Bazaar Gift Cards, Botiq Bazaar Credits & Botiq Bazaar Coupons
Once you are enrolled in Botiq
Bazaar Payments, you can receive payments via Botiq Bazaar Gift Cards, Botiq
Bazaar Credits, and Botiq Bazaar Coupons, all of which are subject to the
policies outlined in the Botiq Bazaar Gift Cards, Credits & Coupons Policy.
In addition, for transactions involving Botiq Bazaar Gift Cards, Botiq Bazaar
Credits, and Botiq Bazaar Coupons, Botiq Bazaar imposes the same payment
processing fee as described earlier.
Botiq Bazaar Payments Policy
By using Botiq Bazaar
Payments, sellers can accept a variety of payment methods, including credit
cards, debit cards, Botiq Bazaar Gift Cards, Botiq Bazaar Credit, Botiq Bazaar
Coupons, select bank transfer services, PayPal (if available), Apple Pay,
Google Pay, and certain country-specific installment payment options. These
payment methods are available on WWW.BOTIQBAZAAR.COM, Botiq Bazaar’s mobile
apps(if exists), and other services. All payments are processed in the seller’s
domestic Botiq Bazaar Payments currency. As a user of Botiq Bazaar Payments,
you are bound by the terms and conditions outlined in this policy, which is a
part of Botiq Bazaar’s overall Terms of Use. By using Botiq Bazaar Payments,
you agree to comply with this policy and the Terms of Use.

Accepting These Terms
The Botiq Bazaar Payments
Policy (referred to as the “Policy”) outlines your rights and
obligations when using Botiq Bazaar Payments on Botiq Bazaar’s Services,
including WWW.BOTIQBAZAAR.COM, Botiq Bazaar’s mobile apps, and other related
services. Please review the Policy carefully before using Botiq Bazaar
Payments, as your use of the service indicates your agreement to the Policy.
The Policy is a legally binding agreement between you and Botiq Bazaar, with
the contracting entity being HAUSRUPT Inc. (based in the U.S.A.) and its
subsidiaries, depending on your location. For those living in North America or
South America, the contract is with HAUSRUPT Inc., while for those residing
elsewhere, the contract is with Botiq Bazaar, a subsidiary of HAUSRUPT Inc. The
term “Botiq Bazaar” refers to all of Botiq Bazaar’s subsidiaries and
affiliates collectively. If you are based in India, you may also be subject to
the India Payments Terms, which take precedence over the Botiq Bazaar Payments

2. Overview
Botiq
Bazaar Payments enables sellers on Botiq Bazaar to accept various forms of
payment, including authorized credit and debit card transactions, select bank
transfer services, PayPal (where available), transactions via Apple Pay and
Google Pay. Upon acceptance of payment, the funds are credited to the seller’s
payment account with Botiq Bazaar, and can then be deposited into the seller’s
designated bank account. However, Botiq Bazaar reserves the right to modify the
payment methods it accepts through Botiq Bazaar Payments, subject to applicable
law and without notice.
To
use Botiq Bazaar Payments, sellers must be at least 18 years old and register
for and be approved for a payment account with Botiq Bazaar. Botiq Bazaar
Payments is currently available in numerous countries across the globe. Sellers
may only use Botiq Bazaar Payments for items listed on Botiq Bazaar’s Services,
and are required to fulfill orders once payment has been received and reflected
in their payment account. Botiq Bazaar may terminate a seller’s access to Botiq
Bazaar Payments if the seller uses it in any other manner.
Botiq
Bazaar Payments benefits both buyers and sellers as it allows Botiq Bazaar to
monitor transactions and provide support where needed, reducing the risk of
fraud and misuse of the platform.
3. Third-Party Services
Botiq Bazaar has enlisted
the assistance of third-party service providers to offer payment services that
are regulated and undertake many of the functions related to payment
processing. These functions include processing card payments, disbursing funds,
exchanging currency, verifying identities, analyzing fraud, and ensuring
regulatory compliance. Worldpay, PayPal, Adyen, and other licensed payment
providers work with Botiq Bazaar to facilitate card and other payments, and to
distribute funds to sellers. However, the payment provider used and the time
taken to process payments may differ based on the country where you are
located.
In connection with
payment processing, Botiq Bazaar may share your personal or transactional
information with these third-party service providers. If Botiq Bazaar receives
notification that your shop’s content or activity breaches a third-party
service agreement, Botiq Bazaar may, at its own discretion, take action against
your account to comply with their regulations. Such measures may include
canceling a transaction, disabling listings in your shop, suspending or
terminating your selling rights, or eliminating certain payment methods.
PayPal
Botiq Bazaar offers two
types of PayPal services: Integrated PayPal and Standalone PayPal. Integrated
PayPal is available in countries where PayPal can be integrated with Botiq
Bazaar Payments. This service allows sellers to receive funds from PayPal
purchases directly into their Botiq Bazaar payment account, without having to
manage a separate PayPal account. The standard Botiq Bazaar Payments Payment
Processing Fee applies to orders processed through integrated PayPal and no
additional PayPal fee is charged. Standalone PayPal is available for sellers in
countries where Botiq Bazaar Payments is not yet available, or in some markets
where it is not required to use Botiq Bazaar Payments. New sellers who join Botiq
Bazaar in countries where Botiq Bazaar Payments is available must register on Botiq
Bazaar Payments as part of their onboarding process. Sellers who accept
standalone PayPal receive funds directly into their PayPal account and continue
to pay PayPal fees. However, orders paid through standalone PayPal are not
covered by Botiq Bazaar’s Seller Protection Program. Botiq Bazaar may allow
certain eligible sellers to use Standalone PayPal for a limited time, but
during this period, Botiq Bazaar may have to process some PayPal transactions
through integrated PayPal. For example, if a buyer pays with an Botiq Bazaar
Gift Card or Botiq Bazaar Credit and covers the remaining balance using PayPal,
Botiq Bazaar can only process the transaction through integrated PayPal.
Similarly, if a buyer purchases items from multiple shops in a single
transaction and chooses PayPal as the payment method, Botiq Bazaar may have to
process the transaction through integrated PayPal.
4.
Botiq Bazaar’s Rights and Responsibilities
Botiq Bazaar may modify,
discontinue or make available the functionality of Botiq Bazaar Payments at any
time, without prior notice and in accordance with the limitations outlined in Botiq
Bazaar’s Terms of Use. As a precautionary measure, transaction limits may be
imposed on both buyers and sellers, including limits on transaction value,
number of transactions, or cumulative transaction value over a period of time.
If a transaction, deposit or adjustment exceeds the limit established by Botiq
Bazaar, we may decline to proceed with the transaction or permit a buyer to
withdraw from the transaction. Botiq Bazaar has the right to refuse Botiq
Bazaar Payments service to anyone at any time, without giving a reason.
Transactions that Botiq Bazaar deems to be high risk, fraudulent, in violation
of trade sanctions, or in violation of Botiq Bazaar’s Terms of Use may be
declined or refunded by Botiq Bazaar.
Botiq Bazaar may provide
limited payment protection to sellers in cases where a buyer fails to make
payment for a legitimate item purchased using Botiq Bazaar Payments. Botiq
Bazaar maintains transaction records associated with Botiq Bazaar Payments but
does not share secure data such as credit card numbers or bank account
information with sellers. Sellers only receive relevant delivery information
and limited buyer account information necessary to complete the order. Botiq
Bazaar will send any necessary communication regarding the use of Botiq Bazaar
Payments in accordance with their Electronic Communications Policy.
5.
Seller Rights and Responsibilities

refund to a buyer and recoup such funds from the seller if a transaction is
found to be in violation of Botiq Bazaar’s policies. Similarly, if a buyer
submits a charge-back, Botiq Bazaar will respond to the credit card networks on
behalf of the seller involved in the transaction.
Sellers are informed of
each transaction or other information pertaining to Botiq Bazaar Payments using
standard communication procedures, including email or through Botiq Bazaar’s
Messages tool.
Refunds or adjustments
paid by Botiq Bazaar to buyers for payments made through Botiq Bazaar Payments
may be initiated using the refund functionality in the seller’s payment account
for a period of 180 days after the purchase was made. Refunds issued by Botiq
Bazaar will be in the original form of payment, and if such payment is not
available, an Botiq Bazaar credit will be issued.
Sellers using Botiq
Bazaar Payments are required to comply with international trade laws and ensure
that their use of the service does not violate any sanctions, embargoes,
regulations or orders administered by the US Department of Treasury’s Office of
Foreign Assets Control (“OFAC”) or other government agencies.
Finally, sellers are
advised that their bank or card provider may charge additional fees for
transactions made on Botiq Bazaar, and that such fees are not charged by Botiq
Bazaar and are at the discretion of the bank.
6.
Appointment of Botiq Bazaar as Limited Collection Agent for Sellers
Botiq Bazaar acts as an
agent for sellers, solely for the purpose of receiving, holding, and settling
payments. Botiq Bazaar will settle payments received on behalf of each seller,
after deducting any fees owed to Botiq Bazaar and according to the Terms.
Sellers acknowledge that payments received by Botiq Bazaar from buyers fulfill
the buyer’s payment obligations, regardless of whether Botiq Bazaar settles the
payment to the seller. If Botiq Bazaar fails to settle payments as per the
Terms, the seller’s recourse is limited to seeking action against Botiq Bazaar
and not the buyer.
7.
Deposits
A virtual Payment Account
is created for sellers where all funds resulting from a transaction are
reflected as a balance. These funds can be deposited into the seller’s bank
account subject to applicable reserves and deposit delays, in some cases up to
30 days. Reserves may be placed on an account based on risk-based criteria, and
funds in a reserve will not be available for disbursement until the end of the
applicable reserve period. The threshold reserve amount is the amount of funds
a seller must have in their payment account while in reserve before they will
have money available to disburse to their bank account. The threshold reserve
amount will determine the amount of funds available for disbursement as
available funds and the amount of funds that are still pending. Botiq Bazaar
uses different risk factors to determine the reserve amount, including the
seller’s sales volume, delivery times, and order backlog.
If the scheduled Payment
Date falls on a non-business day, the Payment Date will be moved to the next
business day. Changing the frequency of disbursements will result in the next
deposit being initiated on the next business day or applicable Monday. Changing
bank account information requires a waiting period of five calendar days. If Botiq
Bazaar is unable to settle funds or if the seller fails to update bank
information, Botiq Bazaar will hold the funds. If the funds are not claimed
within a certain period or if there is non-compliance, Botiq Bazaar may escheat
the funds to comply with applicable laws.
8. Recoupment
Sellers may be required
to reimburse Botiq Bazaar in situations such as refunds, erroneous
transactions, charge-backs, payment processing fees, any taxes, or policy
violations. Botiq Bazaar may obtain reimbursement by deducting from future payments,
charging their payment account, or using third-party collections services. Botiq
Bazaar may also suspend a seller’s selling privileges until outstanding
balances are paid.
9.
Payment Processing Fees
Botiq Bazaar charges a
Payment Processing Fee on each transaction processed through Botiq Bazaar
Payments, deducted from the total payment at the time of completion, and
reserves the right to modify the fee at any time. When sellers list and sell in
a different currency than their payment account, Botiq Bazaar charges an
additional 2.5% currency conversion fee. VAT may be charged on seller fees
accrued each month and remitted to relevant tax authorities. When a buyer
purchases in a different currency than their browsing currency, Botiq Bazaar
calculates the listing price in the browsing currency and applies an additional
currency conversion charge. In the US, Botiq Bazaar may earn interest from
balances in their bank accounts.
10.
Reporting Obligations
US
The IRS requires Botiq
Bazaar to file a Form 1099-K for US-based sellers or those paid in USD in
certain cases. If a seller reaches 150 transactions in a year, they must
provide taxpayer identification information to Botiq Bazaar to comply with
these regulations.
Non-US
Botiq Bazaar must report
tax information to local tax authorities in certain non-US countries when a
seller’s sales on Botiq Bazaar to buyers in those countries exceed certain
thresholds. As sellers approach these thresholds, they must add their taxpayer
name and VAT ID to their Botiq Bazaar shop. Sellers will be notified by Botiq
Bazaar when they approach or reach the threshold, and their selling privileges
may be suspended until the information is provided.
11.
Termination
Sellers have the option
to terminate their contract with Botiq Bazaar Payments at any time by adjusting
their account settings. However, Botiq Bazaar also reserves the right to
terminate or suspend a seller’s use of Botiq Bazaar Payments. Upon termination,
any non-disputed Available Funds will be deposited into the seller’s bank
account. Botiq Bazaar may also set off an amount determined by them to cover
any anticipated charge-backs, refunds, fees, taxes, adjustments, or other
amounts paid to buyers from the seller’s payment account for a 180-day period
after termination. Any remaining amount will be disbursed to the seller at the
end of the 180-day period, and if necessary, Botiq Bazaar may seek
reimbursement from the seller to cover additional charge-backs, refunds,
adjustments, fees, taxes, or other amounts paid to buyers.
